Elevamo Terms of Service

Welcome to Elevamo! These Terms of Service ("Terms") strictly govern your access to and use of the Elevamo API, dashboard, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Definitions

  • "Service" refers to the Elevamo platform, API, and associated tools provided by Elevamo.

  • "Organization" refers to the legal entity or group represented by a dedicated workspace within the Service.

  • "Merchant" refers to a sub-identity or brand profile managed within an Organization.

  • "User" refers to an individual authorized to access an Organization's account.

  • "Credits" refers to the prepaid virtual currency used to pay for generative tasks within the Service.

  • "Output" or "Generated Images" refers to any images or data generated by the Service in response to your inputs.

  • "Uploads" refers to any images, text, or files provided by you to the Service.

2. Account and Organization

2.1. Registration: To use the Service, you must register for an account. You agree to provide accurate and complete information.

2.2. Organization Responsibility: The creator of an Organization is responsible for all activity within that Organization, including the actions of invited Users.

2.3. Account Security: You are responsible for maintaining the security of your API keys and credentials. Elevamo is not liable for any loss or damage arising from your failure to protect your account.

3. Credits and Payments

3.1. Credit System: The Service operates on a usage-based credit system. Credits are required to perform generative tasks (e.g., lifestyle generation, material swap).

3.2. Purchases: Credits are purchased in "Packs". All purchases are final and non-refundable, except as required by law.

3.3. Expiration: Credits may have an expiration date, which will be displayed clearly at the time of purchase. Any unused credits remaining after the expiration date will be forfeited.

3.4. Consumption: Credits are deducted at the time a request is processed.

  • If a generation fails due to a system error, credits may be refunded or not deducted, at Elevamo's sole discretion.

  • If a generation is flagged by our safety systems (see Section 6), credits may be refunded partially or in full.

3.5. Shared Pool: Credits are pooled at the Organization level and are accessible to all Users within that Organization.

3.6. Taxes and Invoicing:

  • Taxes: Prices displayed for Credit Packs are inclusive of all applicable taxes. The total amount paid is the final price shown at checkout.

  • Invoicing: Invoices for purchases will be sent to the email address of the User who initiated the purchase.

  • Billing Details: To ensure your invoices contain the correct details for tax deduction (e.g., Company Name, VAT/Tax ID), we may request this information from you via email. It is your responsibility to provide accurate billing details when requested.

4. Usage Rights and Intellectual Property

4.1. Your Input: You retain all rights to the images and text prompts you upload ("Input"). By uploading Input, you grant Elevamo a worldwide, non-exclusive, royalty-free license to reproduce and process the Input solely to provide the Service to you and to improve our products and services. We are committed to keeping your Input secure and will not share it with third parties except as necessary to provide the Service.

4.2. Ownership of Output: Subject to your compliance with these Terms and payment of applicable Credits, Elevamo assigns to you all its right, title, and interest in and to the Output. You have full commercial rights to use the Output, subject to applicable laws. Elevamo imposes no restrictions on your commercial use of the Output.

4.3. AI Disclaimer: You acknowledge that the Service uses artificial intelligence.

  • Output may not be unique and other users may generate similar content.

  • The Service is provided "AS IS" and Elevamo makes no warranties regarding the accuracy, quality, or suitability of the Output.

  • You are responsible for verifying that your use of the Output complies with applicable laws and does not infringe on third-party rights.

5. Data Retention and Privacy

5.1. Retention Policy:

  • Policy Transparency: Images and Uploads are retained for a limited period as defined in our current data retention policy. You can view the specific retention durations applicable to your account in the Organization Settings dashboard or via the API.

  • Updates: Using the Service implies acceptance of the retention periods active at the time of content generation or upload.

5.2. Deletion: If you delete your Organization, all associated data (including Sessions, Images, Uploads, and API Keys) will be permanently and immediately deleted. This action is irreversible.

6. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, sexually explicit, hateful, or violent.

  • Reverse engineer or attempt to extract the source code or underlying models of the Service.

  • Interfere with or disrupt the integrity or performance of the Service.

  • Create multiple Organizations to bypass usage limits or credit restrictions.

7. Limitation of Liability

To the maximum extent permitted by law, Elevamo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

8. Modifications

Elevamo reserves the right to modify these Terms at any time. We will provide notice of significant changes via the email address associated with your account. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

Elevamo Privacy Policy

This Privacy Policy describes how Elevamo ("we," "our," or "us") collects, uses, and discloses information about you when you use our API, dashboard, and related services (the "Service").

This policy applies to "Users" (individuals authorized to access an Organization's account) and the "Organizations" they represent. Even in a business-to-business (B2B) context, we collect data from individuals to provide the Service.

We collect only the information necessary to provide and improve our Service:

  • Account Information: Name, email address, and authentication credentials (passwords, API keys) of Users.

  • Organization Data: Company name, billing address, and tax/VAT identification numbers.

  • Usage Data: Logs of API access, IP addresses, browser type, and interactions with the dashboard.

  • Input Data: Images and text prompts uploaded for generation (processed as described in the Terms of Service).

3. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Service.

  • Process transactions and send related information, including invoices.

  • Send technical notices, updates, security alerts, and support messages.

  • Monitor and analyze trends, usage, and activities in connection with our Service.

  • Detect, investigate, and prevent fraudulent transactions and other illegal activities.

4. Data Sharing

We do not sell your personal data. We may share information only in the following circumstances:

  • Service Providers: With vendors, consultants, and other service providers who need access to such information to carry out work on our behalf (e.g., payment processing, cloud hosting).

  • Legal Requirements: If we believe disclosure is in accordance with, or required by, any applicable law or legal process.

  • Business Transfers: In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business.
